Child Safety Standards

At Spark Platforms Inc. ("Spark"), the safety of minors is our absolute priority. We adhere to a zero-tolerance policy regarding Child Sexual Abuse Material (CSAM) and exploitation. Our platform is a university-verified space designed exclusively for users aged 16 and above, and we employ rigorous measures, including mandatory university affiliation checks, to prevent the presence of children on our platform.
Strict Age Restriction (16+)
Spark is NOT intended for children. Users must be at least 16 years of age to create an account. We do not knowingly market to, collect data from, or serve advertisements to anyone under 16.
1. Definitions
- CSAM (Child Sexual Abuse Material): Any visual depiction of sexually explicit conduct involving a minor.
- CSAE (Child Sexual Abuse and Exploitation): Any act involving the grooming, solicitation, sextortion, or sexual exploitation of a minor.
- Minor: Any individual under the age of 18.
2. Zero Tolerance Policy
We strictly prohibit:
- Uploading, sharing, or soliciting any content depicting minors in a sexual manner.
- Grooming or predatory behavior towards any user.
- Attempts by adults to solicit minors for sexual purposes.
Immediate Action: Any user found violating this policy will be permanently banned, and their details will be reported to relevant authorities immediately.
3. Reporting & Enforcement (NCMEC)
We work with law enforcement to protect children.
- NCMEC Reporting: If we detect or are alerted to CSAM, we file a CyberTipline report with the National Center for Missing & Exploited Children (NCMEC) in accordance with U.S. law (18 U.S.C. ยง 2258A).
- Data Preservation: In cases of CSAE, we preserve user data (IP logs, interaction data) to assist law enforcement investigations.
4. Content Moderation & Feedback
We use a hybrid approach to ensure safety:
- User Reporting: Every post, shadow, and profile has a visible "Report" tool. Reports related to child safety are prioritized for immediate human review (within 24 hours).
- Live Audio Reporting: Because our Live Voice Rooms are real-time and not recorded, standard automated hash-matching does not apply to active audio streams. We rely on immediate peer reporting and empower Custom Room creators with instant kick/ban capabilities to enforce community safety.
- Automated Filters: For text and media, we utilize pattern matching to block keywords associated with predatory behavior and hash-matching technology to prevent the upload of known CSAM.
- In-App Feedback: Users can certify the effectiveness of our safety tools through the dedicated feedback channels in the app settings.
5. Age Assurance
To enforce our 16+ restriction, Spark utilizes a multi-layered approach:
- University Verification: Users must provide a valid university email or ID for verification to gain access to both the mobile app and Spark Web.
- Platform Signals: We cooperate with platform-level age assurance tools, such as the Google Play Age Signals API, to identify and block underage accounts.
- Monitoring: We terminate accounts immediately if underage use is suspected or reported.
6. Global Compliance Framework
Our child safety standards are aligned with international and national laws to ensure protection worldwide:
- United States: Compliance with the Children's Online Privacy Protection Act (COPPA) and mandatory reporting to NCMEC.
- European Union: Adherence to the GDPR for minors' data and the Digital Services Act (DSA) for content moderation.
- United Kingdom: Alignment with the Online Safety Act, including risk assessments for child harm.
- Australia: Compliance with the Online Safety Act and reporting to the eSafety Commissioner.
- India: Adherence to the Digital Personal Data Protection Act (DPDP) and Information Technology Act child protection rules.
- Other Jurisdictions: We adapt to local laws, such as Canada's Protecting Canadians from Online Crime Act and Brazil's Marco Civil da Internet, and cooperate with international bodies like Interpol.

8. Advice for Parents
Since Spark is an app for older teens and university students:
- If you discover your child (under 16) has misrepresented their age to create an account, contact us immediately.
- We will verify the information and promptly delete the account and all associated data.
- We recommend parents use device-level controls (e.g., parental settings on iOS/Android) to monitor app usage and discuss online safety with their teens.
